ANTENUPTIAL CONTRACTS

No one goes into a marriage with the thought that it might fail. That is why having the conversation about entering into an Antenuptial Contract, is not one that you want to have with the excitement of the wedding in front of you.

One of the most important notarial service that you will need is when you are going to get married. In South African Law the default matrimonial property system is that of a marriage in community of property and therefore you need to enter into an Antenuptial Contract with your prospective spouse to exclude community of property

Your Antenuptial Contract will regulate your matrimonial property, and specifically exclude community of property and community of profit and loss (in order to keep the assets of the one spouse out of reach of the creditors of the other), with or without the application of the accrual system. You can also use this Contract to make donations to your spouse or protect certain specific assets by expressly excluding them from the accrual system

If you do not enter into and execute an Antenuptial Contract prior to your marriage it will result in having to apply to the High Court to have a Postnuptial Contract registered.
